Agreement to Terms

Welcome to Email Verifier ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, API, and email verification services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

By using our Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• You are not located in a country that is subject to US government embargo
• You will use the Service in compliance with all applicable laws and regulations
• You are not a competitor of Email Verifier or using the Service for competitive purposes

Account Registration

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

Service Description

Email Verifier provides email validation services that help businesses verify the deliverability of email addresses. Our Service includes:

• Bulk Verification: Upload CSV files for batch processing
• API Access: Real-time verification through REST API
• Single Verification: One-off email checks through dashboard
• Reporting: Detailed analytics and exportable results

What We Verify

• Syntax validation
• Domain existence and MX records
• SMTP server verification
• Disposable email address detection
• Role-based account detection
• Spam trap identification

Fees and Payments

Pricing

Our fees are based on the number of email verifications ("credits") you purchase. Current pricing is available on our Pricing page. We reserve the right to modify pricing with 30 days' notice.

Payment Terms

• Payments are due at the time of purchase
• We accept major credit cards and PayPal
• All fees are non-refundable except as required by law
• Taxes may be added where applicable

Credit Usage

• 1 credit = 1 email verification
• Unused credits roll over month-to-month
• Credits do not expire while your account is active
• We do not provide refunds for unused credits

Subscription Plans

• Monthly subscriptions are billed in advance
• Annual subscriptions receive a 50% discount
• You may downgrade or cancel at any time
• Cancellations take effect at the end of the billing period

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Upload or verify email lists obtained through illegal means
• Verify email addresses without proper consent
• Send spam, unsolicited messages, or harassing content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the integrity of the Service
• Reverse engineer or decompile any portion of the Service
• Use the Service for competitive benchmarking

Data Usage and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices described in the Privacy Policy.

Email Lists

• You retain all ownership of uploaded email lists
• We process lists only for verification purposes
• Lists are automatically deleted after 30 days
• We do not use your lists for any other purpose

Verification Results

• Results are available for download for 30 days
• Aggregated, anonymized data may be used for service improvement
• Individual email addresses are not shared with third parties

Intellectual Property

The Service, including its code, design, and content, is owned by Email Verifier and protected by copyright, trademark, and other intellectual property laws.

License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to these Terms.

Restrictions

• You may not copy, modify, or create derivative works
• You may not remove copyright or proprietary notices
• You may not resell or sublicense the Service
• You may not use our trademarks without permission

Third-Party Services

Our Service may integrate with third-party services (e.g., payment processors, cloud infrastructure). We are not responsible for the practices of these third parties. Your interactions with them are governed by their own terms and policies.

Termination

By You

You may terminate your account at any time through your dashboard or by contacting support. Upon termination, you will lose access to your account and any pending results.

By Us

We may suspend or terminate your account immediately for:

• Violation of these Terms
• Non-payment of fees
• Suspected fraudulent or illegal activity
• Actions that could harm our Service or other users

Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF RESULTS
• UNINTERRUPTED OR ERROR-FREE SERVICE

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EMAIL VERIFIER BE LIABLE FOR:

• INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR DATA
• BUSINESS INTERRUPTION
• DAMAGES ARISING FROM YOUR USE OF THE SERVICE

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

Some jurisdictions do not allow limitations on implied warranties or consequential damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Email Verifier, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your uploaded content or email lists

Dispute Resolution

Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of laws principles.

Arbitration

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions.

Small Claims

Either party may bring qualifying claims in small claims court.

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically.

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Email Verifier regarding the Service.

Severability

If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right does not waive that right.

Assignment

You may not assign your rights without our written consent. We may assign our rights freely.
